• E-Gift Voucher is not redeemable for cash or credit nor can be exchanged for a gift voucher/Gift card.
• E-Gift Voucher cannot be reloaded.
• E-Gift Voucher is valid for a period of 1 year from its date of issue.
• If the E Gift Voucher is lost or stolen, neither will a new E-Gift Voucher will be issued nor will the money be reimbursed in any manner.

• Balance in SS Credits can be redeemed for merchandise at website/app/chatbot www.BIVOL.IN and the Bivol mobile applications for shopping.
• By using SS Credits, you agree to all Terms & Conditions for SS Credits.
  Balance in SS Credits is not redeemable for cash or credit nor can be exchanged for a e-gift voucher/gift voucher/gift card.
• Balance in SS Credits must be utilized by indicated expiry date. The expiry date of individual line items under SS Credits cannot be extended under any circumstances.
• If any one or more of Gift Cards or E-Gift Voucher is loaded into SS Credits, then it cannot be used from outside of SS Credits for transaction involving combination of payment tenders Gift Cards and / or E-Gift Voucher along with SS Credits at website/app/chatbot www.BIVOL.IN and the Bivol mobile applications for shopping.

  The order of redemption of individual line items in SS Credits is based on nearest date of expiry. This cannot be changed.

Payment Terms

• You agree to pay the price applicable for the product or service on our website/app/chatbot (www.bivol.in) and the Bivol Limited mobile applications for shopping at the time you submitted your order (Product Price).
• All payments are non-refundable (except as expressly set forth in the Terms and Conditions).
• For order value greater or equal to Rs.50,000/- you will be requested to share any one of the identity proof such as Aadhaar card, PAN card or Driving license to process the order.

Terms & Conditions for COD

• Currently, we are not accepting COD orders until COVID-19 situation is back to normal. However, we are able to accept prepaid orders but our delivery times might be affected with limited staff.

Revalidation of Expired Bivol Gift Card/EGift Card

• In light of COVID-19 situation, we are extending the validity of all Gift Card/EGift Card expired during the lockdown period.
• For revalidation you may write to us on customercare@bivol.in or call us.
• The request shall be accepted only after due verification and subject to the applicable terms and conditions at the time of issuance of voucher.

Revalidation of Expired Bivol Credit Note

In light of COVID-19 situation, we will extend the validity of credit notes expired during the lockdown period. Please walk in to your nearest store for assistance once its open.

Account and registration obligations

Customers opting for guest checkout will be automatically registered once order is successfully placed.

Your Information is defined as any information you provide to us in the registration, buying or listing process, in the feedback area or through any e-mail feature or a written letter or form mailed or submitted to any of our stores and offices. We will protect your Information in accordance with our Privacy Policy . If you use the Website/app/chatbot, you are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. Bivol shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. If BIVOL.IN has reason to believe that there is likely to be a breach of security or misuse of the BIVOL.IN Website/app/chatbot, we may require you to change your password or we may suspend your account without any liability to bivol.in.
BIVOL.IN does not want to receive confidential, proprietary or trade secret information through this Website/app/chatbot (excluding information related to any order you submit). Please note that any information, materials, suggestions, ideas or comments sent to BIVOL.IN will be deemed non-confidential. By submitting any such information, you are granting BIVOL.IN an irrevocable and unrestricted license to use, modify, reproduce, transmit, display and distribute such materials, information, suggestions, ideas or comments for any purpose whatsoever. If you provide any information that is untrue, inaccurate, incomplete, or not current or if BIVOL.IN has reasonable grounds to suspect that such information is untrue, inaccurate, and not current or not in accordance with the User Agreement, BIVOL.IN has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Website/app/chatbot.
• That in the event that a non- delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by BIVOL.IN for redelivery shall be claimed from you and you shall pay such cost.
• That you will use the services provided by Bivol.in, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using the Website/app/chatbot and transacting on the Website/app/chatbot.
• You will provide authentic and true information in all instances where such information is requested of you. BIVOL.IN reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), BIVOL.IN has the right in its sole discretion to reject the registration and debar you from using the Services of BIVOL.IN and or other affiliated website/app/chatbot without prior intimation whatsoever.

• First citizen membership program and its members
  Members of First Citizen Loyalty Program of Bivol can accrue reward points for purchases made at BIVOL.IN within the Terms of Use (Available in all our stores) defined by First Citizen Program. BIVOL.IN has a detailed account linking process to enable customers to redeem their reward points online. Customers have to fill and submit a separate form to activate this facility and acknowledge that they are solely responsible for risks associated with activating online reward point redemptions and will not hold Bivol or any of its subsidiaries responsible for any loss arising due to such transactions. For online point redemptions, BIVOL.IN reserves the right to obtain collateral authorization on members credit / debit card for the full value of the order, even if the member is redeeming sufficient points to meet the order value. Such authorization will be subsequently reversed upon successful capture of the reward points from the members First Citizen Account.
• During End of Season Sale, Golden Glow First Citizens get an additional 5%* discount (as First Citizen Reward Points) on nett prices of sale merchandise. For eligible customers, 5% extra discount will be reimbursed in the form of points.
• For orders placed via Cash on Delivery, no points will be earned.
  By choosing to link your First Citizen Membership with your BIVOL.IN account and redeem your reward points online you agree that your credit/debit card will be authorized for the full value of your order, even if you have chosen to pay partly or fully by First Citizen Reward Points redemption. If at the time of shipping your order, the reward point balance which you have chosen to redeem is available, then only the excess amount, if any, shall be charged to your credit/debit card
  However, if the reward point balance is insufficient at the time of shipping your order, your credit / debit card shall be charged for the shortfall in reward point balance.

Quantity restrictions

BIVOL.IN reserves the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit / debit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. BIVOL.IN also reserves the right, at our sole discretion, to prohibit sales to any one as it may deem fit.

However, in some cases where the order quantities are large, we may verify in order to ensure your security, to confirm that you have indeed ordered for these items

Order placed by Cash on Delivery are restricted to a count of 5 orders per day with a maximum limit of 25 orders per month.
There are no restrictions to the maximum number of prepaid orders that can be placed in a day/month.

BIVOL.IN hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user.

Pricing information

While BIVOL.IN strives to provide accurate product and pricing information, pricing or typographical errors may occur. BIVOL.IN cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, BIVOL.IN shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, BIVOL.IN may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and BIVOL.IN will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that BIVOL.IN accepts your order the same shall be debited to your credit / debit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to BIVOL.IN dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit / debit card account.

In case of mispricing

Despite our best efforts, a small number of the many hundreds of items in our catalogue are mispriced. However, we verify prices as part of our dispatch procedures. If an item’s correct price is lower than our stated price, we charge the lower amount and send you the item. If a product’s correct price is higher than our stated price, we will cancel your order and notify you of that cancellation.
We strive to provide you with best value. However, sometimes a price online may not match the price in a store in your particular geographic region and store pricing may sometimes differ from online prices. Prices and availability are subject to change without notice.

Cancellation by bivol.in

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will inform you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit / debit card has been charged, the said amount will be reversed back in your Card.

We will seek authorization on your Card for the aggregate amount of the order placed by you, however, we may charge your card (capture) only with the amount corresponding to the actual portion of the order that we are able/willing to fulfill, and any associated shipping charges/taxes and levies etc. Any surplus amount, for which we might have originally sought and received an authorization on your card from your Card Issuer, if not captured by us in the time period stipulated by our Merchant Banker, will not be captured / charged. If however the same is charged to your card / bank account in error, we will refund it as soon as the same is realized by us or brought to our notice, whichever is sooner. BIVOL.IN reserves the right to capture / charge your card to the full or partial authorized amount for the concerned order.

Cancellation of fraudulent orders

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, BIVOL.IN reserves the right to cancel pending and future orders without any liability. BIVOL.IN also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website/app/chatbot and stock unavailability. We may also require additional verifications or information before accepting any order. If your order is cancelled after your card has been charged, the said amount will be reversed to your Card Account. Any promotional voucher used for the cancelled orders may not be refunded.

Cancellations by the customer

You may cancel your order or some items in your order before we bill and ship the items. You may also exchange the merchandise or get a refund by returning the merchandise (with the exception of perishables, made to order, or items of personal hygiene such as under garments and cosmetics) in unused, saleable condition in its original packaging along with original tags, for a return or an exchange, within 14 days from the date on which these goods are delivered. For details of how to exercise this right please see our Returns Policy. Bivol.in does not accept returns or exchanges of jewellery, fragrances, cosmetics, sunglasses, innerwear (under garments), swimwear, gift vouchers, First Citizen Membership, mobile phones/ MP3 players, and any made to order or altered merchandise. In case we receive a cancellation notice and the order has not been processed /approved by us, we shall cancel the order and refund the entire amount, if any, charged to your card. However, orders placed for the First Citizen Membership or gift vouchers cannot be canceled or returned. The customer agrees not to dispute the decision made by BIVOL.IN and accept BIVOL.IN decision regarding the cancellation.

RETURNS/EXCHANGE AT SHOPPERS’ STOP STORES

Exchange/Return facility is temporarily unavailable at stores due to safety concerns surrounding COVID-19 restrictions. The same shall be available once the situation is back to normal.

Most items are returnable in our stores, to check which items cannot be returned in our stores please call our customer care on 1-800-419-6648. You may visit any Bivol store in India, and return the merchandise in unused, saleable condition, along with the original sale invoice.

If you return any merchandise purchased on BIVOL.IN at any Bivol store, you shall be issued a Bivol credit note against receipt of the merchandise, which may be redeemed against any purchases of an equivalent amount from any Bivol store within 180 days.

Please note that the original Bivol credit note must be produced while redeeming against any purchases. We shall not be responsible in the event the original credit note is misplaced or destroyed.

The Bivol credit note can only be used to pay for purchases at Bivol stores, and cannot be redeemed against purchases made on Bivol.in

The issue of the Bivol credit note, to the person returning the merchandise, against the returned merchandise shall be sufficient discharge to Bivol for the return of the merchandise, regardless of whether the payment for the original purchase was made by credit / debit card, e-gift voucher, First Citizen points, or through any other means.

Returns / exchange through courier collection

• You can continue to raise Exchange/Return request for all eligible online orders however the pick up of the item(s) via courier will be delayed due to COVID-19 restrictions. The same will be available once the situation is back to normal.
• Any refund against a return request made to BIVOL.IN customer support, and collected by courier from the delivery address where the item was originally delivered, shall be processed only upon receipt of the merchandise in unused condition, along with the original sales invoice.
  After the merchandise is received by Bivol.in, and subject to verification of the purchase and condition of merchandise we shall process a refund/exchange within 5 working days of receipt of the merchandise.
• Refunds of payments charged to the Cardholder’s credit / debit card will only be credited back to the Cardholder’s credit / debit card account, which was used to pay for the original order. Please note that we shall not be responsible for any delays in credit to the Cardholder’s credit / debit card account as that is managed by the Cardholder’s issuing bank.
  Due to the introduction of GST, there will not be any online refunds for orders placed on or before 30thJune 2017. Please contact our customer care for further assistance.
• Some items can only be returned through courier collection process
  Financial details You agree, understand and confirm that the credit / debit card details or other financial details provided by you for availing of services on BIVOL.IN will be correct and accurate and you shall not use the credit /debit card or financial facility which is not lawfully owned / obtained by you. You also understand that any financial information submitted by you is directly received by our acquiring bank and not stored by Bivol.in. BIVOL.IN will not be liable for any credit / debit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively on you. This clause shall survive the expiry or termination of this User Agreement.

TERMINATION

This User Agreement is effective unless and until terminated by either you or Bivol.in. You may terminate this User Agreement at any time by informing us in writing through Indian postal system by registered post, that you no longer wish to be associated with this website/app/chatbot, provided that you discontinue any further use of this Website/app/chatbot.
BIVOL.IN may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Website/app/chatbot. Such termination will be without any liability to Bivol.in. Upon any termination of the User Agreement by either you or Bivol.in, you must promptly destroy all materials downloaded or otherwise obtained from this Website/app/chatbot, as well as all copies of such materials, whether made under the User Agreement or otherwise. Bivol.in’s right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website/app/chatbot or affect any liability that may have arisen under the User Agreement.

Entire agreement

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between you and BIVOL.IN with respect to the BIVOL.IN website/app/chatbot/services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and BIVOL.IN with respect to the BIVOL.IN website/app/chatbot/services. Bivol.in’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

Governing law and jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Chennai shall have exclusive jurisdiction in any proceedings arising out of this agreement.
Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Bivol Limited. and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Chennai. The High Court of judicature at Chennai alone shall have the jurisdiction and the Laws of India shall apply.

Modification of terms and conditions of service

BIVOL.IN may at any time modify the User Agreement without any prior notification to you. Subsequent to any modification of the User Agreement, we will inform you of the modifications in the User Agreement via e-mail at the address provided by you while registering on Bivol.in. You can access the latest version of the User Agreement at any given time on Bivol.in. You should regularly review the User Agreement on Bivol.in. In the event the modified User Agreement is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified User Agreement.
